Seller agreement
Last updated 26 October 2026. Draft for South African legal and accounting review before website payments launch.
Current marketplace service
This agreement supplements our marketplace terms. MyTradeMarket provides listings, messages and private deal arrangement records. Website checkout, escrow, bank account checks, payment confirmation and payouts are not active. A deal record does not create payment protection or appoint MyTradeMarket to hold seller funds.
Seller identity and authority
Provide accurate names, a profile photo and business information where applicable. Only list equipment you own or are authorised to sell or rent. Be ready to demonstrate ownership or authority, serial numbers, condition, service history and any finance or other claims over the equipment during an agreed inspection. Do not upload ID documents, bank statements or bank details to public profiles, listings or messages.
The current verified seller badge means staff business profile review only. It does not confirm personal identity, contact details, bank account ownership or authority to sell a specific machine. Those checks require approved specialist services and a secure private process before payment activation. An ownership declaration in a deal record is not independent verification.
Sale commission
Marginal commission applies to completed sales originating from marketplace listings or enquiries. Existing agreed proposals retain their frozen estimates. Rental commission is zero. Provider charges are separate, default to the seller and remain unconfirmed. A deal proposal freezes its price and estimate for an audit record; it is not a payment initiation snapshot or invoice.

Email records and transport responsibility
Buyers and sellers must organise shipping and transport themselves, including booking, loading, unloading, insurance and any necessary permits or customs arrangements. Agree who pays and record the arrangements before proceeding. MyTradeMarket does not provide transport or automatically include it in the equipment price.
Saving a proposal or recording a deal action submits a confirmation to the acting participant's verified account email, subject to delivery availability and email preferences. Either participant can request their own event confirmation from the deal's audit history. These emails are deal records, not payment receipts. Genuine email payment receipts require verified payment notifications after an approved website payment service is connected.
Inspection, collection and delivery
Agree equipment price, collection or seller delivery, transport costs, loading and unloading, cargo insurance, inspection requirements and handover evidence in writing. Use a private deal record in Messages. For sales, support must coordinate addresses without public contact sharing. Rentals may coordinate directly.
Inspection should cover the machine's identity and serial number, ownership or authority, condition, operation, included accessories and agreed documents. Keep dated condition photographs, inspection findings and a handover receipt. Current deal records accept written evidence summaries only; there is no evidence document upload or independent inspection service. A buyer's recorded handover confirms their statement only, not payment or fund release.
Cancellations, damage and non delivery
Before committing, agree a cancellation procedure and responsibility for costs, subject to applicable consumer rights. For damage, misrepresentation or non delivery, preserve the listing, messages, transport documents and inspection evidence. Record the problem and submit a trade dispute in Messages. Staff review does not guarantee compensation and cannot reverse an outside payment. Do not record a satisfactory handover if the equipment is missing or materially differs from the agreement.
Commission refunds follow our refund policy. Equipment refunds remain the parties' responsibility under their contract and applicable law.
Requirements before protected payments
TradeSafe is our selected payment provider. Website payments remain unavailable until the integration and marketplace fund flow are confirmed. Before accepting website payments, published provider compatible terms must specify who pays gateway fees, whether those fees are refundable, commission reversals on full and partial refunds, chargeback evidence and deadlines, and any reserve or lawful seller fund recovery after payout. No automatic debit, seller reserve or fund recovery power currently exists.
A South African lawyer and accountant must review the payment flow, seller agreement, consumer law duties, tax/VAT treatment, invoices and treatment of seller funds. Nothing on this page claims that review is complete or that MyTradeMarket is authorised to operate escrow. Applicable statutory rights cannot be waived by this draft.
Rental risk and equipment return
Rent out at your own risk. Equipment may not be returned, or may be stolen or damaged. MyTradeMarket does not guarantee return or recovery and does not provide rental insurance or compensation. Agree written hire terms, return dates and suitable insurance before handing equipment over. This warning does not remove statutory rights or legal responsibilities. If equipment is not returned or theft is suspected, report the concern and contact the appropriate authorities and your insurer.
